Major Changes in US Immigration: What You Need to Know in 2026

US immigration rules in 2026 are changing across H-1B work visas, student visas, visitor visas, and employment-based green cards, with some changes in force and others blocked by courts or still proposed.

Few countries are watched as closely by families in Gujarat as the United States. Many of us have a cousin on an H-1B, a child on a student visa, or parents who visit every few years.

In 2026, almost every route to the US has changed or is being fought in court. That is why so much of what you read online contradicts itself. Some changes are in force. Some were announced but are blocked by a court. Some are only proposals. This guide separates the three, with dates, so you know which ones affect your plans today.

Is the US Still Issuing Visas to Indians in 2026?

Quick Answer: Yes. India is not on the US travel ban list or on the 75-country immigrant visa pause. But every route now involves more scrutiny, higher costs or longer waits.

The US also tightened screening in 2025 and 2026, including online-presence (social media) reviews for students and for H-1B and H-4 applicants. The rest of this guide covers what that means for each route.

What Changed for H-1B in 2026?

Quick Answer: The H-1B lottery is now weighted by wage level, and a $100,000 payment on some new petitions was announced but is currently blocked by courts.

The weighted lottery (in force). For the FY2027 season, USCIS stopped treating every registration equally. A registration gets between one and four entries in the selection pool depending on the wage level of the job offered, so higher-paid roles have better odds. The final rule was published on 29 December 2025 and took effect on 27 February 2026. The registration fee was $215. USCIS reached the 85,000 cap and confirmed there would be no second selection.

What this means for you: entry-level offers (wage level I) are the most affected, and the wage level of your job offer now matters as much as your degree.

The $100,000 payment (blocked). A proclamation signed in September 2025 imposed a one-time $100,000 payment on certain new H-1B petitions for workers outside the US. USCIS later clarified that it does not apply to extensions, amendments or changes of status for people already inside the US, which covers most F-1 to H-1B changes.

The timeline since then has moved quickly:

What Changed for H-1B in 2026?
Date What happened
8 June 2026 A federal court in Massachusetts vacated the policies implementing the payment
24 July 2026 The First Circuit declined to pause that ruling while the appeal continues
18 September 2026 A new proclamation extended the payment requirement to 21 September 2027
30 September 2026 A federal court in California separately blocked enforcement

As of 12 October 2026, employers are not being required to pay it. The litigation is not over, and the rule could return if a court decides differently, so check the current position before any filing.

What Changed for Indian Students in the US in 2026?

Quick Answer: A rule ending "duration of status" for students was published but blocked by a court before it took effect, and a proposed $70,000 OPT fee is open for comment. Neither is in force today.

Duration of status (blocked). For decades, F-1 students have been admitted for "duration of status", meaning as long as they stay enrolled. DHS published a final rule on 17 July 2026 to replace it with a fixed admission period of up to four years, extension applications to DHS, and a shorter grace period after study (30 days, not 60). It was due to take effect on 15 September 2026. On 14 September, a federal judge postponed it nationwide. The government filed an appeal on 30 September. Until the courts decide, the old system still applies.

The OPT fee (proposed). On 7 and 8 October 2026, DHS proposed a $70,000 fee for a student's first OPT and $30,000 for each later OPT, including STEM OPT. Under the proposal, the school pays the fee before recommending a student for OPT, and could pass the cost to the student or employer. Comments are open until 9 November 2026. Nothing has been finalised, and existing OPT and STEM OPT rules still apply.

What is already in force for students. Most student visa applicants must attend an in-person interview, and the State Department reviews online presence, so keep your social media consistent with your application.

If you are choosing a country for study, compare the total cost and the work-rights picture across several countries, including Germany, the UK, Dubai and New Zealand, before paying a US university deposit.

What Changed for US Visitor Visas (B1/B2) From India?

Quick Answer: Most applicants now need an interview, the cost has gone up, and wait times vary widely by consulate.

  • Interviews. Interview waivers have been narrowed, so most applicants attend in person.
  • Where to apply. You generally apply in your country of nationality or residence. In India, you can book at any of the five US posts: New Delhi, Mumbai, Chennai, Hyderabad or Kolkata.
  • Cost. The visa application fee is $185. The $250 Visa Integrity Fee is charged when a visa is issued, which would bring the total to $435. Collection has been uneven across consulates, so confirm what your consulate expects before you pay.
  • Wait times. Reports from mid-2026 range from roughly 3 months to about 11 months depending on the consulate. Check the live wait time on the official State Department site and compare posts.
  • What decides the outcome. The officer wants to see a genuine visit, funds that fit the trip, and strong ties to India. Documents that contradict each other cause more refusals than a weak profile.

Our existing guide to the USA visitor visa from India covers the step-by-step process.

What Does the October 2026 Visa Bulletin Mean for Indian Green Card Applicants?

Quick Answer: India's EB-2 category reopened in October 2026 after being unavailable, but the dates are still more than a decade behind for EB-2.

What Does the October 2026 Visa Bulletin Mean for Indian Green Card Applicants?
Category (India) Final Action Date Dates for Filing
EB-1 1 February 2023 1 July 2024
EB-2 1 November 2013 15 January 2015
EB-3 1 January 2014 15 January 2015

Final Action Dates decide when a green card can be approved. Dates for Filing decide when you can file your application. USCIS announces each month which chart to use, so check before you file. The bulletin changes every month, and the new fiscal year began on 1 October, so dates can move either way.

What Is the Trump Gold Card, and Is It Worth Considering?

Quick Answer: The Gold Card lets applicants pay for a green card route through EB-1 or EB-2, but Indian applicants still face the same per-country backlogs.

The programme opened on 10 December 2025. Applicants pay a non-refundable $15,000 processing fee, and after vetting, a 1millioncontribution(2 million for a corporate card). It leads into the existing EB-1 or EB-2 categories, which carry per-country caps. In court, DHS said Gold Card petitions will not necessarily be decided faster than others. A lawsuit challenging the programme is pending. For anyone from India, the backlog in the table above still applies, so take legal advice before paying anything.

How Do I Choose the Best Immigration Consultancy in Ahmedabad for US Visas?

Quick Answer: Pick one that is clear about what it can and cannot do, shows itemised fees, names who will handle your file, and never promises approval. No consultancy controls a US visa decision.

Ahmedabad has many agencies, and the US is the destination where scams are most common. Use this list to compare any agency, including us:

  • No guarantees. US consular officers make the decision. A promise of approval is a red flag.
  • No "inside contacts". In one case reported from Ahmedabad, a man allegedly collected ₹41.75 lakh from US visa aspirants by claiming his cousin worked in the immigration department. No contact can speed up a visa.
  • Know the limits of a consultancy. An Best Immigration Consultancy in Ahmedabad can help you prepare documents and understand the process. Legal advice and representation on US petitions, status changes and green cards should come from a licensed US immigration attorney.
  • Beware job and sponsorship offers for a fee. Paying for an H-1B "job" or "sponsor" is a common fraud.
  • Itemised fees in writing, with government and embassy fees shown separately.
  • A named person who handles your file, and a signed agreement.
  • Checkable credentials. Ask for registrations and verify them yourself. Our guide to scams in Ahmedabad explains how.

Speak to two or three consultancies before you decide and compare their answers.

What Nobody Tells You

Most headlines about US immigration are either "the door is closing" or "nothing has changed". Both are wrong. In 2026, several of the biggest rules are announced and then blocked, so a rule being in the news does not mean it applies to you today.

The risk runs both ways. A rule that is blocked now can return if an appeal succeeds, and a rule that is only proposed can become final after the comment period. The safest approach is to plan so that your decision still works under either outcome, and to check the status on the day you file or pay.

Frequently Asked Questions

Is the $100,000 H-1B fee in effect?

Not currently. Courts blocked enforcement, and as of 12 October 2026 employers are not being required to pay it. A new proclamation extended the requirement to 21 September 2027, and the litigation is continuing.

Did the rule ending "duration of status" for F-1 students take effect?

No. It was due to take effect on 15 September 2026, but a federal court postponed it nationwide on 14 September 2026. The old system continues while the case and the government's appeal proceed.

Is OPT ending?

No. OPT and STEM OPT continue under current rules. DHS has proposed a $70,000 fee for first OPT and $30,000 for later OPT, but this is only a proposal, with comments open until 9 November 2026.

How much does a US visitor visa cost for Indians in 2026?

The application fee is $185. A $250 Visa Integrity Fee is also in law and is charged when a visa is issued, which would bring the total to $435. Collection has been uneven, so confirm with your consulate.

Is India on the US travel ban list?

No. India is not on the travel ban list or on the 75-country immigrant visa pause.

How long is the EB-2 India wait?

In the October 2026 Visa Bulletin, India EB-2 has a Final Action Date of 1 November 2013, so applicants with priority dates before that can be approved. Anyone with a later date still waits.

Which is the best immigration consultant in Ahmedabad for a USA visa?

No agency can name itself best for every case, so compare them on the same points: no guarantees, itemised fees, a named person handling your file, checkable credentials, and honesty about when you need a US attorney. Winny Global is one Ahmedabad option you can assess the same way.

Can a consultant guarantee a US visa?

No. US consular officers make the decision, and anyone who promises approval, or claims an inside contact, should not be trusted.
